Free way from the Cdm to the new Road Code

ROMA (ITALPRESS) – The Council of Ministers approved the new Road Code. The reform foresees “a general decrease in fines and, at the same time, a decisive contrast, wanted by Minister Salvini, to the behaviors that jeopardize the safety of all road users,” explains Mit in a note. “The rationalization of sanctions, in addition to the suspension of the two-year automatic adjustment to inflation, sees a rounding down of the amounts regarding the legislation in force: the most common minimum edicts of 26 and 42 euros descend respectively to 25 and 40 euros, while the sanctions of 83 and 87 euros are reduced to 80 euros – the ministry continues -. At the same time, the new Code tightens the measures for those who circulate without insurance, providing for the prohibition of timeless circulation. The obligation of insurance is also introduced according to the Italian rules for foreign vehicles that circulate in Italy for more than 30 days and the co-active collection of sums not paid by foreign users is foreseen”. News also on the front of the notifications of the minutes of contestation, “to protect the drivers and the right to defend: with the new text, the Municipalities will have 45 days, instead of 90, to notify the minutes when the warning happens remotely and without immediate dispute”.

The obligation is also exceeded to carry with it the paper documents of driving and circulation, which can be verified telematically by the police bodies.
The new text also simplifies procedures relating to the Unified European Disabilities Mark (CUDE): all Municipalities will have to adhere to the national platform, in order to guarantee the recognition of the mark on the whole Italian territory and in case of default, they will not be able to use remote inspection devices for violations related to the reserved stop and restricted traffic zones (ZTL). With regard to the two wheels, bikers can use the emergency lane on the highway in case of accidents or slowdowns, while for the so-called drive cycles, (e.g. the bikes used by riders), will trigger the obligation of helmet and mark. For electric scooters, however, the prohibition of circulation will be introduced when they constitute an obstacle or a danger to pedestrians. Finally, the anagraphic limit for professional transport with all licences of group 2 (C1, C1E, C, CE, D1, D1E, D and DE) is raised from 68 to 70 years, with the obligation of biennial verification.
