ROMA (ITALPRESS) – The Competition and Market Authority has expanded the investigation process initiated against Meta Platforms Inc., Meta Platforms Ireland Limited, WhatsApp Ireland Limited and Facebook Italy Srl – indicated as Meta – with reference to the contract terms WhatsApp Business Solution Terms.
These conditions exclude from the WhatsApp platform, from 15 October 2025, Meta AI competitors in the AI Chatbot service market. At the same time as the extension of the object of the current investigation, the Authority also initiated the procedure for the adoption of any precautionary measures with regard to the new contractual conditions of WhatsApp Business Solution Terms (introduced on 15 October 2025) and the integration of additional new instruments of interaction or functionality of Meta AI in WhatsApp.
According to the Authority “this modification of contractual conditions is likely to limit production, outlets or technical development in the AI Chatbot service market, to consumer damage, and constitutes a possible violation of Article 102 TFEU”. Moreover, the Authority believes that “the violation of Meta’s competition law can affect, in a serious and irreparable way, the market’s litigation, because of the poor consumer propensity to change the habits that hinders the transition to competitive services”.
