ROMA (ITALPRESS) – “The Council of Ministers has approved two legislative decrees concerning the grounding of what is contained in l. 132/25 on the subject of artificial intelligence discipline: it is a complex measure, which recalls the competence of more than half of the government”. The undersecretary underlines this at the Presidency of the Council Alfredo Mantovano at a press conference after the Council of Ministers. “Italy, by virtue of these implementing decrees and of the abovementioned law, is the first nation that is endowed with an organic national legislation on this matter – Mantua continues, – Comparation with other European States see these at a somewhat less advanced level of treatment than we. These decrees will go to the evaluation of parliamentary committees, the Conference of the Regions and some guarantee authorities: from this examination will result a further enrichment of an already articulated and complex framework”.

“These decrees have been drafted and compiled in absolute accordance with the EU rules on artificial intelligence: they do not introduce an alternative discipline to the European framework, but they ensure the implementation in the national order: this has happened through a constant dialogue with the European Commission on both formal and informal levels,” explains Mantovano “In line with l. 132/25 the approach foresees that there is no shared message in the center, but the person discerns.

“The decree that we have approved regulates for the first time in an organic way the use of artificial intelligence for police forces: the goal is to provide the functions of security services with the most advanced technologies. Artificial intelligence is an innovative tool to support the activity of the police operator, but not a substitute for human decisions: every use must be respectful of the rules on the protection of personal data, proportioned and subjected to revision or qualified human surveillance; it is therefore not an automated policeman. There are stringent rules for real-time biometric identification for police purposes: this is allowed only in exceptional cases.” Thus the Interior Minister Matteo Piantedosi at the press conference after the Council of Ministers. “There is no generalized Big Brother, the use of biometric databases created with mass collection is forbidden: there are also specific training elements for police operators and the possibility of experimenting new artificial intelligence solutions in high-risk environments,” he explains.

“Real-time use, even before the crime commission, may occur in case of specific danger or threat or for the search for missing persons or victims of trafficking, kidnapping and sexual exploitation: however, a request by the public security authority at the address of the Prosecutor of the Republic is necessary for the authorization of the judicial authority,” adds Piantedosi. “The conservation of the biometric data collected for only seven days with subsequent automatic cancellation, the conservation of the logs of the operations for five years without possibility of modification, the prohibition of making decisions that adversely affect the person based only on facial recognition and the prohibition of any type of generalized and un targeted biometric identification if disconnected from a specific crime or criminal proceedings,” the Minister concludes.
