ROMA (ITALPRESS) – “The Constitutional Court was struggling, but since its first judgment it worked with incisiveness, immediately solving a question concerning the scope of its jurisdiction with a perennial statement: the union of constitutional legitimacy could not be extended also to the primary legislation before the Constitution; what was to immediately establish the mission of the Court as a guarantor of the process of democratization of the order”. This was said by the President of the Constitutional Court, Giovanni Amoroso, on the occasion of the ceremony, at the Quirinale, of the 70 years of activity of the Court. “With that first pronunciation, the constitutional illegitimacy of a provision of the single text of public security in 1931, typical of the authoritarian state of the past,” added Amoroso, underlining how, in these years, he has always worked “as a custodian of constitutional legality and not already as a reviewer of the political choices of the legislator in the exercise of popular representation, which connotes our system of democracy. The Court was faithful to its mission as custodian of the Constitution, with a progressive role of greater impact – concluded the President of the Constitutional Court –, interpreting radical changes in society and the legal order and honing over time the rules of constitutional judgment.”.
