ROMA (ITALPRESS) – “Stop to the bond of exclusivity for healthcare professionals of the sector and openness to free profession”. This is the request of Diego Catania, President of the National Federation of Orders of Technical Health, Rehabilitation and Prevention (Fno Tsrm and Pstrp), who deposited, at the Chamber of Deputies, a petition to definitively repeal the bond, provided for in Article 4, paragraph 7, of the Law 30 December 1991, n. 412, and from Article 53 of the Legislative Decree no. 165 of 30 March 2001.
Provisions that prevent health professionals from carrying out free-trade activities outside the service time, without alternatively providing adequate economic enhancement to compensate for this bond, as happens for other health professions.
With the last Milleprorogue Decree, the bond was temporarily suspended until 31 December 2027. However, it remains a decisive obstacle: the exercise of the free profession is subject to the authorization of the employer, which is granted only in rare cases.
“We want to transform a temporary derogation into a structural rule – says Catania –. The bond of exclusivity imposed on health professionals, employees of the SSN derives from an anachronistic normative system, which does not take into account the evolution of the health system and contrasts with the constitutional principles of health protection and freedom of private economic initiative”.
The bond determines a significant disparity in treatment with other health professionals, who can carry out the free profession, in compliance with the norms, bringing a serious vulnus to the health professionals of the sector.
“To definitively exceed the bond of exclusivity – continues Catania – would guarantee an effective equivalence between health professionals, with positive relapses both in terms of professional enhancement, and for the continuity of the performance rendered to the assisted persons, and in economic terms. The possibility of dealing with different business and organizational contexts, acquiring new clinical and communication skills would bring an immediate benefit to the public service, supporting the motivation and sense of responsibility of professionals.”.
The openness controlled to the free profession for all health professionals would also allow to increase the offer of performance and reduce the waiting lists, giving tangible answers to the health needs of citizens, without weakening the SSN, but on the contrary strengthening it through the full enhancement of the human capital that animates it.
Addressing political decision-makers, Catania launches an appeal: “We call for urgent intervention to definitively abolish the bond of exclusivity. It is a cultural leap required by the times and evolution of skills. I trust that Parliament will be able to listen to the voice of the many colleagues who belong to the professions of the sector, so that we will soon arrive at a structural reform, which recognizes the real value of health professionals and contributes to the overall improvement of the services offered to citizens”.
