CATANZARO (ITALPRESS) – The Tribunal of Catanzaro, in the reception of the defensive thesis of lawyers Salvatore Cerra and Francesco Gambardella, has defined, read in a note, the criminal proceedings under the former undersecretary Giuseppe Galati, concerning the Foundation Calabresi in the World, proceeding, to the outcome of the debate, sentence of absolution with broad formula for a leader of imputation.
The decision “significantly declares the position of the former President of the Foundation and former MP of the Republic, excluding any profile of criminal liability in relation to the alleged distraction of public funds for personal purposes. The acquittal invests one of the central points of the accuser system, that concerning the disputed stipulation of a lease that, according to the prosecution hypothesis, would have determined an exclusive advantage”.
On this point, the Court held that “the contested conduct does not exist, excluding both the appropriation of public resources and the existence of a personal benefit attributable to Galati. The outcome of the debates, therefore, excludes the configurability of the distraction of funds and the use of public resources for purposes outside institutional purposes, giving back a coherent and penally relevant framework.”.
In the course of the judgment it emerged as “the work of the then President of the Foundation took place in the perimeter of the institutional purposes of the institution, without violations of the constraints of destination of regional resources or undue interference in administrative management. With regard to the remnant, reported to facts dating back to the period 2012-2013, the Court ruled the non-place to proceed in the course of the terms of law. A definition that definitively put an end to the story also on this profile, in a context in which the diabetic instructor had already returned a fully clear and favorable picture, without any emergency of criminal liability. It should be remembered that in recent months the Court of Appeal of Catanzaro has placed the compensation for Galati in relation to other proceedings in which he had been involved and subsequently exonerated by request of the same district attorney”.
